Prescription Drugs in Nevada:

The sale of prescription drugs and their unlawful possession is punished harshly in the state of Nevada; drugs like cocaine, heroin and ecstasy may seem like they render punishments more severe than drugs available by prescription but that is not necessarily the case.




Nevada has significantly increased prescription drug charges and penalties in response to the rising rate of prescription medication abuse. The penalties for unlawful possession of prescription drugs vary by number of offenses with a controlled substance in the past:

  1. On your first or second offense: A first or second conviction is a category E felony which can carry 1-4 years in a Nevada State Prison. It is possible to avoid prison and you can potentially avoid a conviction with your participation in a rehabilitation program or with drug education. 

  2. Third or subsequent offense: This becomes a category D felony in Nevada, which can constitute a 1-4 year sentence in prison alongside a $20,000 fine.
